According to the DMCA (  The Digital Millennium Copyright Act )

Your allowed 1 back up of anything you own. As in you purchased a copy. The reason for this is incase you damage the original disc. Which just happenes to be in this case. The only trouble is you need a mod chip to run copied PS2 games which is a pain in the a$$. PS2's are the hardest console to mod. But I'm not going to get into that on these forums hehehe.  ;D

I think that everyone agrees with me when I say that its perfectly clear that Paul is allowed to make/download a copy of the pc version instead, to avoid modding fees.

lol, just kidding... Even I can see that that would be illegal...  ;) Although an eye for an eye... lol
Shameless promotion :)

I don't think Paul has really twisted enough arms yet.  Usually with my kids this is where I get involved.  I have have countlessly had some vendor tell my kids that something can't be done and then I get on the phone and it gets done.

I'd give Activision another call and ask to speak to the supervisor of the person on the phone.  If I still didn't get satisfaction then I would ask to speak to their supervisor.  If I still didn't get satisfaction I would ask to get the name and address of the person responsible for their damaged cd/dvd policy.  I would then write that person what I experienced on the phone and what I think is a reasonable replacement policy.

Paul, is the top of the DVD scratched at all?  Those are the scratches that are devastating.

ElDiablo (Paul)

I haven't done that YET...my brother is going to rent the game this weekend from Blockbuster though! lol

No Bruce the top is fine as far as I can tell. I haven't CALLED anyone and since I don't have a decent long distance service (all of them have pissed me off at one time or another) I don't see me wasting any more of my money on this. I think that I've already gotten as much satisfaction from them as I am ever gonna get. Hence the Blockbuster fix, etc...  ;)

OH you guys GOTTA check this CRAP out! Here is the response from Aspyr...these are the guys making the PC version of the game. This is THEIR idea of customer service I guess!

Howdy Paul,

Thanks for the feedback.

This is the single worst example of customer service skills that I have seen or heard of since the movie CLERKS! This IMHO is indicative of the customer service that you can expect should you buy the game and have a problem with it. Something to think about. I know that I will definately NOT be buying the game now. However...I will be getting it! You figure that out...lol

Given the sheer balls of these people to give such an incredibly thoughtless and rude response as the above...I see NO reason to contribute to making these guys any richer.

from the looks of how this sh!t is going we will all be downloading the game :P lmao

This looks like an e-mail was sent to a feeback mail box and someone is just zipping through them replying but not reading.

That company has nothing to do with the game or Paul's problem.  It's sort of like asking Rainbow to fix a problem with Midtown Madness (created by Angel Studios and sold by Microsoft).  Microsoft is the one you would need to go to.

If you want good games buy them.  If you steal them we won't have good games.  If you have a problem with Activision or whomever.  Let them know in writing (not just by e-mail or phone).

The wrong way to protest is to not buy the game and then steal it.  The only people you are hurting are the developers (the people that work hard to create the games for you) and yourself.

It is the theft of PC games that have actually caused the lack of motorcycle game development for the PC.  Publishers/Producers didn't take long to realize that they can make a lot more money for a lot less hassle by developing for consoles.
